“Nurturing a Safe Haven for Our Youth” – Controversy Ignites Following Judge’s Order to Prohibit Hormone Replacement Therapy for Transgender Minors

In a ruling this Tuesday, Judge Sarah Geraghty stated that Georgia can continue its ban on hormone replacement therapy for transgender individuals under the age of 18.

This decision comes in the wake of an Alabama federal appeals court allowing the implementation of a similar ruling last month.

As of now, around 22 states have executed laws either restricting or entirely prohibiting transgender treatment for minors. Legal battles have been ignited in most of these states in response to these laws.

Request to Reconsider the Injunction

Georgia’s move to resume the ban came shortly after the Alabama ruling, prompting the state attorneys to request Judge Geraghty to consider revoking the preliminary injunction that was previously in place. Geraghty had initially issued this injunction just a day before Alabama’s ruling.

Judge Geraghty’s Response

Judge Geraghty stopped short of completely retracting her prior decision, explaining that following the 11th Circuit Court of Appeals’ ruling on Alabama’s case – a court of which Georgia is a part – maintaining her injunction was unfeasible. 

Putting a Stay on the Injunction

Instead, she chose to put a stay on the injunction, awaiting a potential reevaluation of the Alabama case by a larger segment of the court’s judges.

Reactions to the Ruling

Kara Richardson, the spokesperson for the Georgia attorney general’s office, commented on the ruling with approval, saying the office “will continue fighting to protect the health and well-being of Georgia’s children.”

Plaintiff’s Disappointment

On the other hand, attorneys representing the plaintiffs voiced their disappointment, especially for the affected families who now face limitations in their medical choices for their children in Georgia. They made it clear, however, that their legal journey is far from over.

Alabama Precedent

Last month’s ruling on the Alabama case stated that the state has the right to enforce a prohibition on hormone blockers and treatments for transgender minors. 

Senate Bill 140

Georgia’s own Senate Bill 140, implemented on July 1st, allows doctors to prescribe puberty-halting medication.

Children who have already started hormone therapy can continue with it, but the law bars any new patients below 18 from starting on hormone therapy and also outlaws most gender-affirming surgical procedures for transgender minors.

Judge Geraghty’s Earlier Decision

This law, which officially came into effect on July 1st, faced an obstacle when Judge Geraghty issued a preliminary injunction blocking it on August 20th. This action was initiated after parents of transgender children filed a lawsuit against the ban alongside a community organization.

Weighing Imminent Risks

Explaining her prior decision, Judge Geraghty emphasized the significant “imminent risks” that transgender children face, petitioning the injunction, might encounter due to the ban.

Such hazards included possibilities of depression, anxiety, self-harm, eating disorders, and suicidal tendencies. Geraghty firmly stated that these potential dangers posed to the children notably outweighed any possible harm an injunction might inflict on the state.

11th Circuit’s Compelling Interest

However, the 11th Circuit judges who ruled in favor of Alabama’s law clarified that states possess “a compelling interest in protecting children from drugs, particularly those for which there is uncertainty regarding benefits, recent surges in use, and irreversible effects.”
