In October 2018, as Biden secured a Colt Cobra Special revolver from a Delaware gun store, he declared on the required forms that he was “not an unlawful user of and addicted to any stimulant narcotic drug.”

Yet, around him at the time were well-documented accounts of his struggles with crack cocaine.

In a statement that underscored the broader implications of the case, Lowell said, “But a prosecutor, with all the power imaginable, bending to political pressure, presents a grave threat to our system of justice.”

Opinions from the legal arena seem split. Randy Zellin, a professor at Cornell Law School, called the entire situation a “nonsense case.”

Highlighting the lack of victims, Zellin questioned the rationale behind such a case, especially given Biden’s previously clean slate.

The Collapse of the June-July Deal

As of June, a two-part agreement between the prosecutors and Biden’s defense had materialized, only to disintegrate in July.

This deal would have seen Biden confessing to late tax payments for two years and admitting illegal firearm possession.

In return, he would sidestep a felony charge, opting instead for drug treatment and monitoring. However, U.S. District Court Judge Maryellen Noreika held her ground, refusing to “rubber stamp the agreement.”

Davis Weiss Takes the Lead

Davis Weiss, the Justice Department special counsel appointed in August by Attorney General Merrick Garland, is at the helm of these charges against Biden.

Weiss had expressed intentions of indicting Biden by September’s end.

He tweeted, “But unless U.S. Attorney Weiss investigates everyone involved in the fraud schemes and influence peddling, it will be clear President Biden’s DOJ is protecting Hunter Biden and the big guy.”
